1. SALES TERMS
GENERAL CONDITIONS
These terms and conditions apply to the rights and obligations arising from the purchase of goods between customers of the Trademall OÜ online store www.engasco.ee (hereinafter ``Client'') and Trademall OÜ (hereinafter ``Seller''). In addition to these terms and conditions, the legal relationships arising from the purchase of products from the www.engascobaltic.eu online store are governed by the legislation in force in the Republic of Estonia.
ENTRY INTO CONTRACT
The sales contract comes into effect from the moment the total amount of the order has been received on the account of Trademall OÜ. The seller does not have to notify the customer of his acceptance of the order separately. By completing the purchase and paying the payment, the Customer confirms that he has familiarized himself with the ordering conditions.
PRICES
The prices in the www.engascobaltic.eu e-shop are in Euros and include VAT.
PROCEDURE AND DEADLINES OF PAYMENT FOR GOODS
The buyer can pay for the goods in Euros in one of the following ways:
1.1 Electronic banking - this is payment for goods through the electronic banking system used by the customer. If the goods are paid for in this way, the payment for the goods is generated in the electronic banking system according to the customer's order. The customer transfers the money to the current account of the bank chosen by him. In this case, the responsibility for data security rests with the bank, as all financial operations take place in the bank's electronic banking system. In the www.engascobaltic.eu e-shop, it is possible to pay via the bank link of Swedbank, SEB, LHV, Luminor and Coop banks and with a Visa Mastercard credit card.
1.2 By bank transfer - this is payment for goods, when the customer transfers money from his current account to the Seller's current account according to the submitted Order invoice.
1.3 Trademall OÜ is the controller of personal data, Trademall OÜ transmits the personal data necessary for making payments to the authorized processor Maksekeskus AS.
HOW TO ORDER
Select the required product from the product catalog or search, and add the desired product to the shopping cart if it is suitable.
You can see the products you have selected in the shopping cart. Check the order, fill in the required fields with your data and press the "order" button.
You will receive an order confirmation by e-mail. The payment term is 3 days, and if there is no receipt within this time, the order will be cancelled.
Pay in the bank: Click on the icon of the Payment center and select the appropriate bank and make the payment - be sure to press the button "back to the merchant"
NB! The seller begins to fulfill the order after receiving the payment to the account of Trademall OÜ.
DELIVERY COSTS AND DEADLINES
All orders, if the goods are in stock, will be fulfilled after receipt of payment, within a couple of working days or a week at the latest. If the delivery time of the ordered product turns out to be significantly longer for any reason, we will inform the Buyer immediately, inform the arrival time of the new item or return the money if desired. In general, the delivery time of ordered goods is up to 14 days.
Trademall OÜ will deliver the products together with the user manual in Estonian and other related documents to the courier company selected by Trademall OÜ within the previously agreed upon deadline.
NB! The delivery information applies to orders within the Republic of Estonia.
RETURN OF GOODS
You have a 14-day right of return for goods purchased from the www.engasco.ee online store from the moment you receive the goods.
The right of return is designed so that the buyer can examine the product as he would in a physical store and then decide whether he wants to keep the product or return it.
Returned goods must be unused, with tags and in the original packaging. The package can be opened without damage (if possible), if not, with as little damage to the package as possible.
In order to return the goods, you must submit an application to us at the e-mail address info@engascobaltic.eu within 14 days of receiving the goods, where the order number and date must be indicated.
Returning the goods is done at the customer's expense.
When returning goods, the purchased product/products must be returned immediately, but no later than within 14 days from the submission of the application for withdrawal.
Upon receipt of the returned goods, the online store will return to the buyer immediately, but no later than 14 days after receiving the withdrawal, all fees received from the buyer based on the contract, including delivery costs.
The Online Store may refuse to issue refunds until it has received the item that is the subject of the contract or until the buyer has provided evidence that it has returned the item, whichever occurs first.
If the goods have been used for purposes other than what is necessary to verify the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.
RIGHT TO MAKE A CLAIM
The deadline for submitting claims applies to the goods in accordance with the laws of the Republic of Estonia together with the order confirmation (sent automatically to your e-mail) and a document proving payment. A claim can be submitted within two months from the discovery of the defect. The deadline for filing claims does not apply to goods whose defects result from improper use or normal wear and tear.
In case of complaints and claims, please send a relevant e-mail. Complaints will be reviewed as soon as possible, but no later than within 7 working days. According to VÕS § 218, subsection 2, the Customer has the right to submit a claim within two years from the receipt of the goods. In the case of a defect occurring within one year of this, it is assumed that it was present at the time of purchasing the product, and the nature of the defect must be determined by the seller. If the defect is of a technological nature, the Customer may demand that the product be repaired, and if the repair is impossible or ineffective, the product be replaced or the money refunded.
The seller is not responsible for:
For damage to the product due to the customer's fault or negligence;
For defects that have occurred as a result of non-intended use of the product;
For the natural physical wear and tear of the product under normal use.
SELLER'S RIGHTS
The seller has the right to withdraw from the order if the ordered goods cannot be delivered due to stop of production of said good(s). In this case, the money will be refunded to the Buyer. If desired, it is possible to replace the product with another product or wait for the new product to arrive.

FORCE MAJEURE
Trademall OÜ is not responsible for damages caused to you or delays in the delivery of the goods if the damage or delay in the delivery of the goods is due to circumstances that Trademall OÜ could not influence or foresee.
SOLVING ARGUMENTS
If the Buyer has complaints about the Seller, they must be sent by e-mail to info@engascobaltic.eu or by calling +372 55601508. If the Buyer and the Seller cannot resolve the dispute by agreement, the customer can contact the Consumer Disputes Committee. You can familiarize yourself with the procedural conditions and submit an application by clicking here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the Buyer and the Seller. Review of the buyer's complaint by the commission is free of charge.

OTHER CONDITIONS
Trademall OÜ uses the personal data provided by the Customer only to fulfill the Customer's purchase order. Trademall OÜ does not disclose information obtained during purchases to third parties, except to cooperation partners for order delivery and in cases prescribed by law.
2. WARRANTY TERMS
1. The warranty period starts from the day of purchase. During the warranty period, all product defects resulting from incorrect installation or faulty parts will be repaired free of charge. This warranty does not cover other costs (except parts and their replacement).
The costs of the examination carried out to find out the manufacturing defect must be paid by the product owner, if as a result of the examination it turns out that it is not a defect caused by a manufacturing error.
2. This warranty does not oblige the seller to adjust, clean and maintain the product free of charge, nor to organize free training on the use of the machine.
3. If the user of the product is a private person and uses the product for personal purposes, the seller is responsible for product defects at the end of the specified warranty period in accordance with local law. If the product is used for commercial purposes, the seller's additional obligations are based on the agreement between you and the seller.
4. The guarantor based the guarantee described in this document on the fact that the information given by the buyer about the purpose of use of the product (for personal or commercial use) is true. The guarantor may invalidate the guarantee or change the guarantee conditions unilaterally if it appears that the product has been used in a way other than that which the buyer has reported and signed on the guarantee form received at the time of purchase.
5. The product is accepted for warranty repair only if it is brought to the workshop with a completed and valid warranty document. If an error occurs with the product, please stop using the device immediately and contact the seller.
6. The seller is not responsible for any damages or indirect costs caused by the use of the product, except in cases where local laws stipulate otherwise.
7. Free repairs resulting from warranty conditions will not be performed if:
the product has not been used as intended and the instructions for use, care, transport and storage in the user manual have not been followed;
the user did not inform the seller or the service center about the initial error that appeared on the product and continued to use the device, thereby causing additional damage to the device;
maintenance work has not been performed (cleaning of combustion nozzles, etc. work specified in the user manual);
the wrong gas has been used;
no original spare parts have been used for the repair;
the product has been rented out;
the product no longer belongs to its original purchaser;
8. Natural wear and tear of moving parts is not considered a defect and is not covered by the warranty.
9. This warranty gives you specific legal rights and does not limit any other consumer legal rights.
3. REPAIRE TERMS
1. The basis for the execution of the work is the information agreed in writing at the time of ordering the work and is indicated on the work sheet.
2. Repair of the device is preceded by defecting, i.e. error detection. The defect fee must also be paid if the device's fault is not revealed during testing or if the device is brought in for warranty repair, but it later turns out that it was not a fault on the part of the manufacturer.
3. When bringing the device for warranty repair, the customer is obliged to present the appropriate document proving the validity of the warranty (warranty paper, purchase receipt, etc.). In the event that the defect of the device has occurred for a reason that excludes repair under warranty, the repair is based on an agreement with the customer.
4. The customer is obliged to pick up the device brought for repair within at least 14 days after notification of the completion of the work. In the event that the person ordering the work has not picked up the device within 14 days after notification of the completion of the work, the contractor may demand a fee to cover the storage costs of the device in accordance with the valid price list.
5. Approximate deadline for device repair is 14 calendar days from when the device is brought in for repair. The repair period may be extended for reasons beyond Trademall OÜ's control, due to a long delivery time for spare parts or a particularly hard-to-find fault. The device is handed over to the customer only on the basis of the work sheet!
4. PRIVACY TERMS
OÜ Trademall has undertaken to protect the privacy of customers and users. Based on this, we have prepared these privacy policy principles, which deal with the collection, use, publication, transmission and storage of customer data. Our activities on the Internet are in accordance with all relevant activities and the relevant legislation of the European Union and the laws of the Republic of Estonia.
Collection and use of personal data
Personal data is data that OÜ Trademall collects to identify or contact an individual. Personal data can be collected with the customer's consent in the following ways:
When submitting contact information (including your name, postal address, telephone number, e-mail address, social security number) on our website or in the store
when using the website from the customer's account information or via cookies
when making a purchase or order in our e-shop (the e-shop may ask you to voluntarily provide personal data and personal information in certain areas of the website. The required personal data may include name, address, postal code, e-mail address and telephone number)
when submitting an application for installment payments.
With the help of collected personal data, we can inform customers about OÜ Trademall news, campaigns and future events. A customer who does not wish to be on our newsletter list can remove himself from it at any time. We also use the collected personal data to deliver goods and to fulfill our obligations to the customer. In order to better serve the customer, OÜ Trademall may disclose information about individual users to a third party that provides OÜ Trademall services and is contractually obligated to keep the shared information confidential. A third party is, for example, our partner, whose tasks are
transportation of goods sold in the e-shop or provision of installment payment service.
Protection of personal data
OÜ Trademall applies all precautions (including administrative, technical and physical measures) to protect the customer's personal data. Only authorized persons have access to change and process data.
Security
All personal data of the customer that becomes known during the visit of the OÜ Trademalle store and making purchases is treated as confidential information. The encrypted data communication channel with the banks ensures the security of the personal data and bank details of the person making the purchase.
